Elena Kagan Is Concerned about the Current State of Law

 Elena-Kagan-Is-Concerned-about-the-Current-State-of-Law Elena Kagan has been expressing concerns about the current state of Law in the country and she said that a conservative Supreme Court has been making attempts to cut back on the rights of women, criminal defendants and prisoners.

Throughout her time served with Justice Thurgood Marshall, Elena Kagan had been passing memos to express her concerns. Her memos were kept safe as a record and are currently on a file, in Marshall’s papers at the Library of Congress.

Marshall was the first African-American lawyer with his groundbreaking tactics and arguments against the segregation, who was given part in the court. At this time, Kagan would only be the sixth justice to have served as a law clerk for the high court in the past.

But some bright headed Republicans have already been showing signals of discomfort with Elena Kagan, as she is headed to the final phases of her selection as a Supreme Court Justice. A Law professor at the University of Wisconsin – Brad Snyder said that no one can draw any conclusions from those memos because he has examined relationships between judges and clerks in the past.

While Kagan was just 27 year old, she started working for Marshall in 1987 and she tried to channel Marshall in her memos in accordance to her views and concerns. We can see how her concerns have been echoing through Marshall’s well established views.

For now, we can only hope that whatever happens, happens in the best interest of all sides.
